PRIORITIES OF STATE REGULATION OF INTELLECTUAL PROPERTY IN FOREIGN COUNTRIES: OPPORTUNITIES FOR UKRAINE
Abstract
In this work, an attempt was made to consider the peculiarities of the regulation of intellectual property in foreign countries, in particular the USA, Great Britain and Japan. The study of the US experience is interesting from the point of view of the quantity and quality of adopted laws and decrees regulating the field of intellectual property. Special attention needs to be paid to the well-known Bai-Dole law, which fundamentally changed the state policy in the field of intellectual property regarding the distribution of rights to intellectual property results created at the expense of the state budget. The experience of Great Britain emphasizes the need to properly inform researchers in matters of intellectual property and its objects. Japan has achieved significant success in the field of integration of science and industry and reflected the peculiarities of its own culture in the mechanisms of technological development chosen by it. The use of the available experience of modern, international intellectual property systems of foreign countries is a necessary prerequisite for achieving high economic and social development of any modern state and its formation of appropriate mechanisms for regulating the sphere of intellectual property. The use of best practices for the creation and protection of intellectual property will promote the use and further development of inventive and creative achievements, support and preserve the national potential in the field of intellectual activity and stimulate the attraction of necessary or desired investments, exerting a stabilizing influence on the economic and social development of society and the state, in which both domestic and foreign investors will be confident that their intellectual property rights will be respected and protected. The creation of such a system is also of particular importance for our country, as a country with significant scientific, technical and intellectual potential.
